1. About this policy
This policy sets out the rules for using Ava, the receptionist service provided by 360 AXE (ABN 86 947 578 436). It forms part of our Terms of Service. It applies to every customer, and to anyone who uses Ava through a customer's account. We rely on phone and messaging service providers, and their own rules also apply to phone numbers and messages sent through our service.
2. What you must not do
When using Ava, you must not:
- send spam or unsolicited marketing. Do not use Ava, or any phone number we provide, to make unsolicited marketing calls or send unsolicited marketing SMS. Any messages you send must follow Australian laws such as the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth), and the laws of any other country involved;
- break the law. Do not use Ava for any illegal activity, or to promote, arrange or support it;
- impersonate others. Do not set up Ava to pretend to be another person, business or organisation, or use a business name you are not entitled to use;
- mislead callers. Do not set up Ava to mislead callers about who they are dealing with, what your business is, or what you offer. If a caller asks whether they are speaking with a person, Ava must not be set up to claim that it is one;
- harass or abuse. Do not use Ava to threaten, harass, abuse or intimidate anyone;
- collect sensitive information without a lawful basis. Do not use Ava to collect sensitive information, such as health, financial account, identity document or criminal record details, unless you have a lawful basis and handle it in line with the privacy laws that apply to you;
- abuse or overload the service. Do not try to overload, disrupt, test the limits of, or get around the security of our service, or use it to generate fake call volume;
- record calls. Do not use our services to record calls, or try to make or keep recordings of calls through our services; and
- resell or share the service without our written agreement.
3. Your responsibilities
You are responsible for how Ava is set up for your business, including the greeting, the information it gives callers, and what it asks them. You are also responsible for telling your callers that their calls are answered by Ava on your behalf. See How Ava answers calls for a suggested greeting.
4. What happens if this policy is breached
If we believe this policy has been breached, we may take one or more of these steps, depending on how serious the breach is:
- contact you with a warning and ask you to fix the problem;
- suspend your service, or part of it, until the problem is fixed;
- end your subscription and close your account; and
- report the matter to the relevant authorities, or to our providers, where the law requires it or where we believe it is necessary to protect other people.
Where a breach is serious, or puts people, our service or our providers at risk, we may act straight away without a warning. If our providers suspend a phone number because of how it has been used, we may not be able to restore it.
5. Reporting misuse
If you think someone is misusing Ava, for example by sending spam or pretending to be another business, please email conduct@360axe.com with "Misuse" in the subject line. Please include the phone number involved, the date and time of the call or message, and a short description of what happened. We will look into every report we receive.
6. Changes to this policy
We may update this policy from time to time. We will post the updated version on this page with a new "Last updated" date. If a change could reasonably disadvantage you, section 10 of our Terms of Service applies, including at least 30 days' notice by email and your right to cancel.
